These Terms of Use ("Terms") govern your use of the Mutu mobile application and website (the "Service"). By creating an account or using Mutu, you agree to these Terms. If you do not agree, please do not use the Service.

1. What Mutu is (and isn't)

Mutu is a platform that connects people who want to trade goods and services with each other. Mutu:

Every trade is an agreement made directly between two users, at their own discretion and risk.

2. Trades are at your own risk

Important: You trade at your own risk. Mutu is not responsible or liable for the condition, quality, safety, legality, or accuracy of any listing; for the conduct of any user; for a trade going wrong; for loss, damage, theft, or injury arising from any trade or meeting; or for disputes between users. You are responsible for evaluating the other person, the item or service, and the fairness of any trade before you agree to it.

You may not list or trade anything illegal or dangerous, including (without limitation): weapons, drugs, counterfeit goods, stolen property, hazardous materials, recalled products, anything requiring a licence you don't hold, or services that are unlawful. Mutu may remove listings and suspend accounts at its discretion.

6. Verification is not a guarantee

The verified badge means an account passed a basic real-person check. It is not a guarantee of identity, honesty, or trustworthiness. Always apply your own judgement, whether or not a user is verified.

7. Limitation of liability

To the maximum extent permitted by law, Mutu and its owners, operators, and partners shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of property, profits, data, or goodwill, arising from or related to your use of the Service or any trade, meeting, or interaction with another user. Where liability cannot be excluded, it is limited to the maximum extent permitted by applicable law. Nothing in these Terms excludes liability that cannot lawfully be excluded, including under the South African Consumer Protection Act where it applies.

8. Indemnity

You agree to indemnify and hold Mutu harmless from claims, damages, and expenses (including reasonable legal fees) arising from your use of the Service, your trades, your content, or your breach of these Terms.

9. Suspension and termination

We may suspend or terminate accounts that break these Terms, harm other users, or abuse the platform. You can stop using Mutu at any time, and can request account deletion via our account deletion page.

10. Changes

We may update these Terms from time to time. The date above reflects the latest version. Continued use of Mutu after changes means you accept the updated Terms.

11. Governing law

These Terms are governed by the laws of the Republic of South Africa, without regard to conflict-of-law rules. Nothing in these Terms limits any non-waivable rights you may have under the consumer laws of your country of residence.
